Rental Terms & Conditions

  • Rentals run Saturday -Saturday
  • Check in time is 2:00 pm at our office
  • Check out time is 10:00 at our office
  • Security Deposits are required on all our properties
  • NO PETS/NO SMOKING AT ALL OF OUR PROPERTIES

Lease Agreement

  1. As in accordance with town bylaws, the TENANT agrees not to allow more than the maximum number of people and cars (As stated on the property amenity sheet) ON THE PROPERTY DURING THE DAY AND NIGHT. The TENANT must not interfere with neighbor’s Right of Quiet Enjoyment. Failure to comply could result in forfeiture of security deposit and/or immediate termination of tenancy without refund.
  2. THE TENANT WILL LEAVE THE PREMISES IN THE SAME GENERAL CONDITION AS FOUND UPON ENTRY. All personal property, food and rubbish must be removed; all furnishings are to be placed in their original position.
  3. TENANT will be responsible for all damages or breakage and/or loss to the premises, except normal wear and tear.
  4. If the TENANT defaults regarding any item in this lease, the TENANT agrees to vacate, upon twelve hours notice, and to be responsible for all legal costs plus damages should action be brought to regain possession or repair loss or damage.
  5. The TENANT agrees to let the LANDLORD or his agent, view the condition of the premises, both inside and outside upon four hours notice to the TENANT if requested to do so.
  6. The TENANT will supply towels and bed linens unless otherwise stated on the property amenity sheet. The LANDLORD will supply household furnishings and equipment.
  7. Telephone toll calls are not included. All toll calls must be charged by credit card.
  8. In the event of a subsequent sale of the same premises to said TENANT at any future date, a broker’s fee shall be paid to Martha Murray Real Estate.
  9. REFUND POLICY: If the TENANT cancels this lease prior to occupancy, the deposit may be refunded, less a handling fee of 10% of the total rental, if and when the property is re-rented for the same time period. In the event the premises cannot be re-rented for the full value paid by the TENANT, the refund shall be reduced by the difference of the two rents.
  10. NO ANIMALS (INCLUDING BIRDS) SHALL BE KEPT IN OR ON THE PREMISES. ANY EVIDENCE OF ANIMALS WILL RESULT IN FORFEITURE OF SECURITY DEPOSIT AND/OR IMMEDIATE TERMINATION OF TENANCY WITHOUT REFUND.
  11. Tents, Campfires/Beach Fires are strictly prohibited
  12. Smoking is prohibited on the property
  13. Occupancy (adults, children, infants and guests) is not to exceed the cited limit.
  14. Your final balance will be due four (4) weeks prior to arrival. Sorry, no credit cards are accepted.
  15. SECURITY DEPOSIT as indicated on the reverse side is due with your final balance. The security deposit may be used for repair to the property and/or extraordinary cleaning. Your deposit will be returned within 30 days of your departure.
  16. If I (we) do not personally inspect the premises prior to signing this Agreement, I (we) agree to accept the rental property, as is, upon arrival, provided it meets the basic standards of habitability under Massachusetts law. In addition, I (we) agree that we will not be entitled to a refund of rent money and will have no claim or recourse against the Rental Agent or Martha Murray Real Estate.
  17. CHECK IN TIME IS 2:00 PM AT MARTHA MURRAY REAL ESTATE. CHECK OUT TIME IS 10:00 AM. Late check outs are subject to forfeiture of security deposit.
